8.1.3. Arbitration Panel
The arbitration panel shall consist of a single arbitrator. If the parties are unable to agree on the arbitrator within 30 days of the initiation of the arbitration process, the arbitrator shall be appointed by the competent court in Delhi, India, in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration award shall be final and binding upon the parties, and no party shall have the right to appeal such award, except for the grounds provided in the Arbitration and Conciliation Act, 1996. The award may be enforced in any court of competent jurisdiction.
8.1.4. Confidentiality
The parties undertake to keep the arbitration proceedings and all related documents confidential unless otherwise required by law or necessary for the enforcement of the award.
8.1.5. Costs of Arbitration
The costs of arbitration, including the fees and expenses of the arbitrator, shall be shared equally by the parties, unless the arbitrator decides otherwise based on the circumstances of the case. Each party shall bear its own legal and other costs associated with the arbitration proceedings.
